1. General Information and Acceptance of Terms

These Terms and Conditions govern your use of the stewartdawson.com website (hereinafter referred to as the "Website"). By accessing any part of the Website, creating an account, placing an order, requesting a catalogue, or participating in any competitions offered on the Website, you agree to be legally bound by these Terms and Conditions.
Please be aware that these Terms and Conditions may be updated periodically without direct notice to you. We may indicate the date of the last revision on this page. It is your responsibility to review these Terms and Conditions regularly before making any purchases or utilizing other services to ensure you are aware of any changes. Your continued use of the Website following any changes signifies your acceptance of those revised Terms and Conditions.

2. General Information about the Seller and Product Use

By placing an order, you represent and warrant that all goods ordered are intended for your own private and domestic use only and are not for resale.
We reserve the right, at any time and without prior notice, to discontinue or modify the specifications, prices, designs, features, models, or equipment of our products without incurring any liability, except where required by law.

3. Ordering Process

Purchasing your timepiece is simple and secure:
Select your watch or strap – Browse our curated collection and choose the model that suits you.
Add to Cart – Review details such as strap options, availability, and price in your preferred currency.
Checkout – Enter your shipping information and select your delivery option (standard or express, DDP available for selected countries only).
Payment – Complete your order using our secure payment gateway with multiple currency options.
Order Confirmation – You will immediately receive an email with your purchase details.
Shipping Notification – Once your watch is prepared and dispatched, you will receive tracking information.

4. Price and Payment

4.1. All prices displayed for products on www.stewartdawson.com are stated in Euros (€ EUR) and are exclusive of any applicable Value Added Tax (VAT) (VAT will be displayed and added at checkout for EU orders). Delivery charges are also calculated separately and displayed during checkout.
4.2. The total cost of your order will comprise the price of the selected products and services (after any applicable promotional discounts) plus the relevant delivery charges as outlined in the checkout process.
4.3. For orders with a delivery address outside the European Community (EC), VAT will not be applied. However, we reserve the right to apply VAT to orders with a delivery address within the European Community (EC) at the prevailing rate at the time of dispatch.
4.4. If the VAT rate changes between the date your order is placed and the date of dispatch, the applicable VAT rate will be that in force at the time of dispatch.
4.5. We accept payments via major credit and debit cards through secure payment gateways including PayPal, Stripe, Amazon Pay, Apple Pay, Bitcoin, and Google Pay.
4.6. We do not store your credit card details, and we do not share your customer details with any third parties except as necessary to process your order and payment.
4.7. By placing an order, you confirm that the payment account being used is yours or that you have been specifically authorized by the owner of the payment account to use it. All payment account holders are subject to validation checks and authorization by the card issuer. If your card issuer refuses to authorize payment, we will not be able to process your order and will not be liable for any delay or non-delivery.  

5. Delivery

5.1. We will deliver the goods in accordance with the delivery option you selected during the order process. The estimated delivery period provided is an approximation and not a guaranteed delivery timeframe.
5.2. As we ship from within the European Community (EC), please be aware that for deliveries outside the EU, you may be liable for import duties and taxes, which are levied once the shipment reaches your country. You are responsible for meeting any additional charges for customs clearance.
5.3. Customs policies vary significantly from country to country. We advise you to contact your local customs office for detailed information before placing your order. Please also note that international shipments may be subject to cross-border inspections by customs authorities.  
5.4. Our typical delivery time frame is under a week for shipping, although this can vary depending on the destination. We partner with reputable delivery companies such as UPS, DHL, and FedEx, and the specific carrier for your order will be chosen based on the shipping destination.

6. International Orders

6.1. Please note that we ship our products from Italy. For orders with a shipping destination outside the European Union (EU), your order may be subject to import duties, taxes, and brokerage fees levied by the destination country's government. These charges are entirely the responsibility of the customer and are not included in our prices or shipping fees. We have no control over these charges and cannot estimate them at the time of checkout. We strongly recommend contacting your local customs office for detailed information regarding potential customs costs.
6.2. The designated courier (typically FedEx or DHL) may contact you directly to request your Social Security Number or Tax ID if this information is required for customs clearance in your country. Please understand that this request is beyond our influence if mandated by local regulations.
6.3. If you refuse delivery of your order due to customs charges, the package will be considered abandoned and may be disposed of by the shipping carrier. In such cases, your order will not be eligible for a refund.
6.4. For orders that are undeliverable due to the recipient's unavailability or refusal and are subsequently returned to us, a shipping fee will be deducted from any applicable refund.
6.5. Once an order has been shipped and is in transit, it is not possible to cancel the order. Please ensure the accuracy of your order details before completing your purchase.

7. Returns and Exchanges

7.1. If you are not completely satisfied with your purchase, you may return the product within fourteen (14) calendar days from the date of receipt, provided it is accompanied by the original receipt and returned in its original packaging.
7.2. Before returning any item, you must contact us at assistance@stewartdawson.com to receive guidance on the correct return procedure.
7.3. You are responsible for the costs associated with returning the goods. We strongly recommend using a trackable shipping service provided by major couriers (such as UPS, DHL, FedEx) to ensure the safe return of your item.
7.4. All returned items must be unworn, in their original packaging (including all protective films and covers), and include a completed returns form (which will be provided by our customer service team). Please note that we cannot accept returns of stainless steel bracelets that have been disassembled or adjusted. If a watch is returned in perfect condition but the strap shows signs of use or marks, a refund will only be issued for the watch itself.

8. Try-On Advice for Online Purchases

We understand that purchasing a watch online without trying it on can sometimes be challenging. Therefore, we advise our customers to carefully wrap the watch around their wrist to assess the fit without fastening the strap. Once the strap is fully fastened, the watch is considered worn and may not be eligible for return under our standard policy.
By trying on the watch without fastening the strap, you can avoid any potential marks or damage to the strap.

9. Warranty

9.1. STEWART DAWSON® watches are meticulously designed and assembled in Italy using premium materials and advanced techniques to ensure optimal performance and longevity.
9.2. For repair requests and customer support, please contact us via email at aftersale@stewartdawson.com. To help us expedite your request, please include relevant pictures or videos illustrating the issue you are experiencing, if possible.
9.3. Your STEWART DAWSON® watch is covered by a manufacturer's warranty against material and manufacturing defects existing at the time of delivery for a period of twenty-four (24) months from the original date of purchase, subject to the following terms and conditions:
* The warranty is valid only if the original warranty card is dated, fully and correctly completed, and signed by an authorized STEWART DAWSON® dealer (valid warranty card).
* During the warranty period, upon presentation of the valid warranty card, you are entitled to have any covered defect repaired free of charge, with the exception of transport, insurance costs and tax and duties, which are the responsibility of the customer.
9.4. This manufacturer's warranty specifically excludes:
* Normal wear and tear and aging of the watch (e.g., scratches, alteration of the case and/or bracelet, straps, crystal).
* Any damage to any part of the watch resulting from abnormal or abusive use, lack of care, negligence, accidents (including but not limited to knocks, dents, crushing, broken crystal), incorrect use of the watch, or failure to observe the provided operating instructions.
* Watches that have been handled or repaired by non-authorized individuals or service centers, or which have been altered from their original condition beyond STEWART DAWSON® 's control.
9.5. Under no circumstances shall STEWART DAWSON® be liable for any indirect, incidental, or consequential damages of any kind arising from or in connection with the watch.
9.6. Any further claims against STEWART DAWSON®, beyond the scope of this express warranty, such as claims for additional damages, are expressly excluded.
9.7. This manufacturer's warranty is separate from any warranty that may be provided by the seller, for which the seller bears sole responsibility. It does not affect your statutory rights as a consumer against the seller.

10. Promotional Offer Codes

10.1. From time to time, we may offer promotional codes that provide discounts on specific products or the total value of your order. Unless explicitly stated otherwise, these codes are valid only for the specified promotion and cannot be used in conjunction with any other offers, price reductions, or on sale, clearance, nearly new, or archive items. Promotional codes will also not apply to postage and packaging charges.
10.2. Offer codes are valid only during the specified start and end dates. No codes will be honored for retrospective use after the promotion has expired.
10.3. We reserve the right to withdraw, modify, or cancel any promotional offer codes at any time without prior notice.

11. Legal Title and Risk

The legal title to the goods and the risk of loss or damage to the goods will pass to you upon delivery of the goods to the address you specified in your order.

12. Email Policies

By creating an account and placing an order, you consent to receive email communications from us related to your orders, including order confirmations, renewal or expiration notices (if applicable), dispatch updates, and other payment notifications.

13. Intellectual Property Rights and Trademarks

‘STEWART DAWSON’ is a registered trademark of D GROUP EUROPE BV.
All intellectual property rights, including but not limited to trademarks, logos, designs, and copyrights displayed on the Website and in our materials, are owned by or licensed to D GROUP EUROPE BV and are protected by applicable intellectual property laws. You are not permitted to use, reproduce, or distribute any of our intellectual property without our prior written consent.  

14. Third Party Information Disclaimer

We are not responsible for the content or accuracy of material found on third-party websites or in any other written material that is not directly published by us. The only authoritative prices for STEWART DAWSON® products are those explicitly stated in our official Website and marketing materials. We cannot guarantee the reliability of prices or other information displayed on shopping directories or through any other third-party sources.

15. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of The Netherlands.  
The courts of Amsterdam, The Netherlands shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation (including non-contractual disputes or claims).  

16. Severability

If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these Terms and Conditions.  

17. Entire Agreement  

These Terms and Conditions constitute the entire agreement between you and the customer and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.  

18. Force Majeure

We shall not be liable for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions that are caused by events outside our reasonable control ("Force Majeure Event"). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes (without limitation) strikes, lock-outs or other industrial action, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport, impossibility of the use of public or private telecommunications networks. Our performance under these Terms and Conditions is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under these Terms and Conditions may be performed despite the Force Majeure Event.
