Typographical errors

In the event Stewart Dawson London has an item listed at an incorrect price due to typographical error or systems error, Stewart Dawson London shall have the right to refuse or cancel any orders placed for product listed at the incorrect price.

§ 1 – Scope of application

These standard terms of sale apply to the contract entered into Stewart Dawson London, a brand owned by D GROUP EUROPE Ltd a public limited liability company , registered at the London (England) Company Register, under No. 09089053 and having its registered office at Dashwood House 69 Old Broad Street London, EC2M 1QS, ENGLAND (hereinafter referred to as “Stewart Dawson London”) and the consumer, the client of the online boutique stewartdawsonlondon.com (hereinafter referred to as the “Client”).

For these purposes, “consumer” shall mean any natural person acting for the satisfaction of her personal needs, to the exclusion of any professional needs.

§ 2 – Purpose

The purpose of these standard terms is to define the contractual conditions applicable to the sale of the Stewart Dawson London leather products and watch-straps from the online boutique accessible at stewartdawsonlondon.com.

These standard terms are supplemented by the order form, filled out online by the Client, all of which together form the sales contract entered into between the parties.

§ 3 – Territorial scope

Stewart Dawson London watch-straps can be ordered for delivery to all countries, provided that the Client’s address is served by Stewart Dawson London’s express carrier.

§ 4 – Characteristic of the products offered

The products offered (hereinafter the “Product(s)”) are those appearing in the catalogue published on the pages of the online boutique stewartdawsonlondon.com.

§ 5 – Order

A Buyer wanting to place an order for a Product must:

  • fill out the online order form, selecting all of the references of the Products chosen, in accordance with the process indicated; the Client is entitled to change her/his mind at any time in order to modify her/his choices ;
  • give her/his client number, or fill out the identification sheet on which s(he) will indicate her/his contact information and the desired delivery address ;
  • confirm her/his order, after having checked it ;
  • make payment in the conditions stipulated in the “Payment” article below.

Confirmation of the order expresses the Client’s acceptance of the Stewart Dawson London offer appearing on the order form, as well as the Client’s acceptance of these standard terms of sale.

§ 6 – Prices

§ 7 – Payment

The price of the Products is due at the time of the order.

The buyer’s account will be debited on the date of the order.

A hardcopy invoice, indicating the invoice’s payment, will be sent to the Client with the package containing the Product.

§ 8 – Reservation of title

The Products shall remain Stewart Dawson London’s property, until they have been paid for in full.

§ 9 – Delivery

The Products are delivered by an express delivery carrier, to the address indicated on the order form. The Client can ask that the Product be delivered to a third party, to the latter’s address. Stewart Dawson London does not accept orders having as a delivery address a “PO BOX”.

Stewart Dawson London will inform the Client once the Product has been dispatched, as well as if it has used a package tracking mechanism offered on the carrier’s website. In the event of a simultaneous order for a watch strap and another other leather Product, the watch strap(s) can be delivered in separate packages.

§ 10 – Right to cancel

The custom made products can not be returned or changed. All Stewart Dawson London products are Custom made. All the custom made products styled for mentioned timepieces brands have its standard OEM measurements.

§ 11 – Warranties

The Products are covered by the legal warranty of conformity provided for by European Union. This warranty must be mentioned by the Client within two years from delivery.

Any watch strap delivered, the size of which varies by more than two-tenths of a millimeter in terms of the width of the box and by more than two millimeters as regards the length of the box, compared to the dimensions of the Client’s order, shall be deemed to conform to said order.

The Products are also covered by the hidden defect warranty. This warranty must be mentioned by the Client within two years from the discovery of the defect.

Stewart Dawson London shall not be responsible for the deterioration of a Product that has been used by the Client in a manner inconsistent with its intended use, or in a manner inconsistent with Stewart Dawson London’s recommendations.

§ 12 – Liability

Stewart Dawson London is bound by a best efforts obligation with respect to the online selling process; it cannot be held liable for damages resulting from the use of the Internet network, such as lost data, intrusion, the action of viruses, or a service interruption

Stewart Dawson London shall not be responsible for the non-performance or improper performance of this online sales contract if this non-performance or improper performance is attributable either to the consumer, or to the unforeseeable, unstoppable act or fault of a third-party, or to a force majeure situation.

§ 13 – Intellectual property

Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

§ 18 – Assignment of jurisdiction

Any dispute arising from the validity or performance of this sales contract or from the interpretation of its clauses shall be referred to Her Majesty’s Courts of Justice of England and Wales.

A person who is not party to these terms and conditions or a Contract shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.

§ 21 – Stewart Dawson London & CITES

The Convention on International Trade in Endangered Species of Wild Fauna and Flora, also known as CITES, aims to ensure that trade in specimens of wild animals and plants does not threaten the survival of endangered species in the wild by regulating and monitoring their international trade. The CITES Secretariat is administered by the United Nations Environment Programme (UNEP) and the Convention came into force in 1975.

HOW IT OPERATES
Approximately 5,000 species of animals and 28,000 species of plants are protected by CITES against over-exploitation through international trade. CITES works by subjecting international trade in specimens of selected species to certain controls. All import, export, re-export and introduction from the species covered by the Convention must be authorized through a licensing system.

SUSTAINABLE SOURCING
Stewart Dawson London only produces merchandise using skins from sustainable sources. We do not use species threatened with extinction. The CITES convention skins we import into the EU are accompanied by an export certificate issued by the government of the country of origin.

The rules and legislation vary from country to country. For these reasons, shipment of products may be delayed pending the receipt of the necessary authorizations from the exporting and importing countries.
